Scan Translator's Terms of Use govern the use of online products and services offered by Scan Translator, such as websites, web extensions, mobile applications, widgets, APIs, emails and others. By using these services, you agree to be bound by these terms. If you do not agree to these terms, you may not use these services.

Your access to the Services.

Children under the age of 13 are not allowed to use our Services.
To use the Services, you must be at least the legal age required in your country, or we must have received verifiable consent from a parent or legal guardian to do so on your behalf.
If you are accepting these Terms on behalf of a company or other organization, you represent that you have the legal authority to bind that legal entity to these Terms.

How do credits work on Scan Translator?

Scan Translator offers credits as a way for users to access translation services on our extension. Each credit allows you to translate one image. We offer 3 plans to choose from:

Free - 30 credits each week
Basic - 4.99€ one time purchase credits
Premium - 9.99€ one time purchase credits

Credits can be purchased on our website or through the Pro Version menu in the extension. Once you have used up all your credits, you will downgrade to the free plan and then get 30 credits each week. Credits do not expire and can be used at any time until they are fully depleted.

Your use of the Services

Scan Translator allows you to purchase a personal, non-transferable, exclusive, revocable, limited license key to use and access the Services only as permitted by these Terms. We reserve all rights not expressly granted to you by these Terms.
Except as authorized by the Services or authorized in writing by us, your license does not include the right to: license, sell, transfer, assign, distribute, host, or otherwise commercially exploit the Services or Content; modify, prepare derivative works of, disassemble, decompile, or reverse engineer any portion of the Services; or access the Services or Content in order to construct a similar or competing website, product, or service.
We reserve the right to modify, suspend or terminate the Services (in whole or in part) at any time, with or without notice to you. Any future versions, updates or other features added to the Services will be subject to these Terms, which may be updated from time to time. You agree that we will not be liable to you or any third party for any modification, suspension or discontinuance of the Services or any portion thereof.

Your Content

All ideas, suggestions and comments about Scan Translator or our Services that you provide to us are entirely voluntary, and you agree that Scan Translator may use such ideas, suggestions and comments without compensation or obligation to you.

Third-party content, advertisements and promotions

The Services may contain links to third party websites, products or services, published by advertisers, our affiliates, partners or other users (referred to as 'Third Party Content'). We are not responsible for any third party websites, products or services.
Use of Third Party Content is at your own risk. We advise you to investigate before proceeding with any transaction in connection with such Third Party Content.
The Services may also contain sponsored Third Party Content or advertisements. We have sole control over the type, degree and target of advertisements, and may display them on the Services or in Third Party Content of our choosing.
Scan Translator does not guarantee the uninterrupted availability, timeliness, security or freedom from error of the Services or Content. We assume no liability for errors or interruptions in the Services or Content, or for damages caused by the use of the Services or Content.
You are solely responsible for any damage to your device or loss of data caused by using the Services or downloading the Content.
Scan Translator is not responsible for the actions, Content, information or data of third parties, and you release Scan Translator from any and all liability for any claims or damages related to such actions, Content, information or data.
If you have a dispute with a third party, you release Scan Translator from all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in connection with such dispute.
To the extent permitted by law, Scan Translator makes no warranties, express or implied, with respect to the Services or the Content, including without limitation warranties of merchantability, fitness for a particular purpose and non-infringement.

Modification of Terms

We reserve the right, in our sole discretion, to modify these Terms at any time. If a change is material, we will notify you by posting a notice on the Services. Changes will be effective immediately upon notification. Your continued use of the Services after we post or send you notice will mean that you accept the changes.

Resignation

You may terminate this Agreement at any time by emailing us at [email protected] to delete your Account and related data. If you terminate your Account, we will cancel any remaining credits associated with your Account.
We reserve the right to terminate this agreement and close your Account at any time, with or without cause, and without notice. If we terminate this Agreement without cause, we will refund any remaining credits associated with your Account, unless we have reason to believe that you have violated these Terms or have used the Services in a fraudulent or illegal manner. If we terminate this agreement for cause, any remaining credits associated with your Account will be forfeited and you will not be entitled to any refund.

Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Scan Translator and its affiliates, directors, officers, employees and agents (collectively, the 'disclaimers') will not be liable to you or any third party for any indirect, consequential, special, punitive or exemplary loss, including loss of profits, data, goodwill or opportunity, arising out of or in connection with this Agreement or your use of the Services, even if Scan Translator has been advised of the possibility of such losses.
To the maximum extent permitted by law, Scan Translator's and the exonerated parties' total liability to you for any claim arising out of or in connection with this Agreement or your use of the Services shall not exceed the amount of credits you paid to Scan Translator during the twelve (12) months preceding the claim.

General

This Agreement constitutes the entire agreement between you and Scan Translator with respect to the subject matter of this Agreement, and it supersedes all prior or contemporaneous agreements, communications and other exchanges, written or oral, between you and Scan Translator.
If any part of this Agreement is held to be illegal, void or unenforceable, that part shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
You may not assign, transfer or sublicense this Agreement or your rights and obligations under this Agreement, without our prior written consent. We may assign, transfer or sublicense this Agreement or our rights and obligations under this Agreement without your consent. This Agreement shall be governed by the laws of the State of California, USA, without regard to its conflict of law principles. The parties agree that all disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of San Francisco, California, USA, and agree to submit to the personal jurisdiction of such courts.
